myincomejob.com,and storeby.com,and how do you get there how do you get,to this area privacy messages,to make sure that you can set it up,in your adsense account without using a,plug-in now you could use a plug-in if,you want to but i chose to go the route,of using the back,of signing into my adsense account,and setting it up myself,instead of using another plug-in but the,option is there that's the,you know is that if that's the path you,want to go down,when you signed into your google adsense,account,you click on ads and it brings you to,here,and in this gray box you see how it gets,darker when i place my cursor and above,it it says you can publish a gdpr or,ccpa i have both why not privacy message,by editing your site's setting,settings,so,i went to store by dot shop it populated,here see that,i'm going to go to edit it you see edit,on the right,click it,and it brings you to this page,privacy messages and you turn it on you,see how it's toggled on it's blue it's,toggled on and then you say apply to,site,and then within moments you see this,notification at the bottom,and,when visitors from california,or,european economic area and the uk,this pops up,this,notification i have it set up to show it,this way,you have to play around with it but,that's very important because this this,this is the kind of responsibility,things you must be responsible for,because,oh wow look how that popped up like that,oh because it's not turned on let's turn,it oh let me go to privacy settings,what's this ad settings,oh for auto ads i don't use auto ads but,that is,an option if you like,you see how it's toggled on,i don't want to change it because i,don't want to,i don't want to mess it up you toggle it,on when it's off it's gray,um i got off track,it's your responsibility and if you're,an adsense,publisher,let me show this if,if you're an adsense publisher,you have better odds of companies,showing ads,on your websites because you're taking,this,action to protect,protect gives us a sense of where everyone,participating here is in their,preparations so I really like to look at,privacy laws and compliance as the way,that can help the operation of your,business it surely can be a competitive,advantage as well as make your business,and company more efficient in helping,companies with their GDP our compliance,we've seen activities where data might,have been all over the place for example,maybe they were using plain ol Outlook,to send their marketing messages instead,of utilizing all of the tools at their,disposal because of Gd P R they could no,longer do that and instead needed to,utilize all the marketing tools and as a,result they can then analyze the,information that they have more,effectively they understand who they're,communicating to they can target the,right audience and from a competitive,advantage standpoint I have seen,companies gain clients because they have,privacy ready at their fingertips and,others who have lost clients because,they were not able to agree and say yes,we have managed and can agree that we,are gdpr compliant or we have a strong,privacy and security program so the,companies that take privacy seriously,utilize it in their marketing and,communications of their business will,have a competitive edge over the,companies that do not so why should,everyone care about privacy well I have,a few philosophies it is from a legal,standpoint privacy is sweeping the globe,we're all familiar with GDP are in the,EU GDP r has some cousins if you will,there's some draft form in India there's,a version in,Raziel that is effective August 2020,Canada already has some extensive,privacy laws and they are continuing to,review those to ensure that it meets the,needs of their residents today and we,have in the United States the California,consumer Privacy Act CCPA,there's about nine to ten other u.s.,state laws that are on the docket you,might have been following Washington,state that had passed the Senate but,just last week it actually did not pass,the house so as of now Washington is,closed it's been said that they'll bring,it up most likely next year there are,still as I said a number of other states,in the United States who are looking at,a CCP a light bill or something similar,to it and there's also conversation of a,u.s. national bill and I'm asked all the,time will we have a u.s. national bill,there's a variety of industry groups who,are looking to have something like that,my answer is if it's thoughtful,legislation it will take some time if we,have some pull it up politics at play,it's I would dart and we'll see what,happens but more importantly is that the,customers were serving care about,privacy more than two-thirds of them say,they would like to do more that they,want companies to do more to protect,their privacy they're in support,regulation from advertisers they don't,feel like there's enough regulation in,place to protect them less than 10% of,social media users feel very this question is so hard to answer in itself ,it's the one question that four years ago I posed
to my Tick Tock profile and it blew up overnight ,and it started a series where I was asking people
have they really read all the fine print that they ,sent off on through clicking I agree when they
make an account and I realized no one has time ,for that on top of that a small study was done
in 2008 where they actually looked at how much ,money would take for every single adult to take
time off of work and read the terms of service ,and privacy policy and it showed a net loss of
781 billion dollars really no one has time for ,that and for my community members who follow me
you all know that I read the fine print so that ,you don't have to on top of that terms of service
Community guidelines and privacy policies are not ,really written at a consumable writing level
for most people most of them were found to be ,at a college writing level or a PhD level and
on Tick Tock I really have maybe three minutes ,at most to talk to people about these guidelines
and what's happening but when it gets to privacy ,and data protection online that's where we need
to start a long form YouTube video you may see ,me editor Sean randomly appear in the video don't
be alarmed that's just me adding some context for ,some more Nuance but I'll be back enjoy let's
be honest do you actually read the full terms ,and conditions the vast majority of you just click
I agree blindly no one knows what they're really ,agreeing to I believe that knowledge should be
accessible to all because we don't have the time ,to read all these lengthy contracts do you know
anyone who actually reads the full terms and ,conditions so that you don't have to can provide
you with a deeper understanding of what companies ,are doing with your data once they use it or sell
it or give it away all while maintaining your own ,privacy as a consumer that's too much time that's
too much money and rarely lawyers have the free ,time to do this for us so as consumers who want
more control privacy and transparency with their ,own data it's important that we highlight the rare
companies or startups that are actually enabling ,us to do that as consumers startups that enable
us to unlock their true value of our own data the ,most intimate data purchase data okay let's talk
about some of the rights that you probably don't ,know you have the California consumer Privacy
Act of 2018 news consumers more control over ,their personal data and how businesses actually
collect it now what are some of the rights that ,are listed within this act number one the right
to know you have the right to request the data ,from the company and look at I know exactly what
they've gathered on you number two the right to ,delete you have the ability to ask the company
to purge your data from their servers and most ,of the time a lot of these companies very large
data companies will just automatically Purge your ,data once you delete your account but sometimes
they don't do this you always have to check number ,three you have the right to opt out of the sale
of your information this means the purchase of ,your information the brokering of your information
on top of this the reselling of your information ,meaning you opt out saying this company cannot
sell my data of course there's more Nuance within ,this law and I highly recommend that you go search
it up because a lot of consumers do not know their ,rights and it's very important that you do know
your rights when it comes to the CCPA editor Sean ,here in 2023 it's actually important to note that
we'll be getting something called the cpra the ,consumer privacy Rights Act it will change a few
things from the CCPA but it adds a lot more rights ,and protections for us specifically personally

valuable I want to say that not every company ,will sell your data some companies will broker it
some companies will keep it because it's highly ,valuable now before we can launch ourselves into

hey welcome to today's video,I'm Richard chapo I'm an Internet lawyer,in San Diego today we're talking about,the CCPA versus gdpr,when is consent required so the DPR of,course is general data protection,regulation it is a privacy deregulation,that went into effect in Europe and May,2018 and it made some rather significant,changes to privacy law we saw some,really new concepts and perhaps the most,important one is that you need a legal,basis before you can collect personal,information from individuals online or,offline if you're a business well if,you're anything really and the question,then became okay well what is a legal,basis and the gdpr so a number of,different types perhaps the most common,commonly used type however is to get,consent and this is known as affirmative,consent and basically it's pretty much,what it sounds like you're asking the,individual for the right to go ahead and,collect personal information from them,in certain ways now you're seeing this,online right now if you go to a website,and you'll see a cookie pop up and you,have to agree to allow the cookies to,collect information from you that's what,they're doing there they're complying,with the legal basis requirement of the,gdpr and so it's a fairly fundamental,concept so what about the CCPA well the,california consumer Privacy Act is a,privacy law and that went into well it,was enacted in California in the summer,of 2018 it goes into effect January 1st,2020,now the CCPA has often been referred to,as the gdpr light I don't really think,it is and the reason for that is the,legal basis requirement found in to the,gdpr mmm that doesn't exist into the,CCPA there's no such requirement and the,legal basis for karma the gdpr is really,pretty much the major element of that,regulation so if it's not the CCPA it's,kind of hard to argue that the CCPA is,you know similar to the gdpr now how the,CCPA might be considered to be somewhat,akin to the gdpr is that it represents a,whole new approach to privacy law in the,United States up to this date unless you,were in specific areas like health,records financial records or the,collection of information for minors,under 13,the privacy law in the United States is,really pretty much a joke there just,hasn't really been anything there's,nothing like we see in Europe and maybe,that's for better maybe it's for worse,you'll have to make your own decision of,that but nonetheless the CCPA represents,now a whole new paradigm to privacy law,and it grants consumers things like the,right to access of their information and,right to delete certain information all,right you get copies of their,information all these different things,which we'll talk about in other videos,but what about consent does the CCPA,require consent and the answer generally,speaking it's very important we focus on,that word generally is no you do not,need consent to collect personal,information from California residents,under the CCPA,now they have the right to opt out of,that which we'll talk about again in,another video but you don't necessarily,need affirmative consent up front now,there are two areas however where one,you definitely need it and two you may,need it it's still up for debate so the,first area is what I call who will save,the children and this is a reference to,a character in the Simpsons that used to,always belt this out whenever any kind,of issue came out and apparently the,answer in this case is the California,Legislature so under the CCPA if you,were collecting information from teens,between 13 and 16 years of age you must,get consent from them first you must get,affirmative consent and now if you're,collecting information from kids under,13 you need to get consent from a parent,or guardian you can't get it from the,child and the reason for this is that we,don't feel that the individual under 13,is going to have the mental capacity to,know what they're consenting to at least,that's the approach of the CCPA that,that approach is also kind of nonsense,because in contractual law we typically,don't allow we don't allow kids sign,contracts and be bound by them unless,they are of an age or majority which is,typically 18 because we feel that they,don't have the consent so why the CCPA,is allowing them to consent between the,ages of 13 and 16 is somewhat of a,mystery but hey welcome to California,law so how would these situations arise,well,when you apply it to the practical,scenarios we see online things get a,little ugly because if you think it,through,well how many fifteen year olds do you,think are on Facebook right now and how,do you think Facebook is gonna fire,those people are how are they supposed,to get consent from them it's difficult,to know I think we're we're probably,ultimately headed is what I call the H,gateway and then the liars exemption and,so what will happen is you're going to,have to use age gateways on their site,saying basically that you know you ask,the person when they sign up you know,what's your age they p
